Welcome to the13, a fantasy sports application that lets users join groups and play a Premier League survivor-style contest. By accessing or using the13 (“App”, “Platform”, “Service”), you (“User”, “you”) agree to these Terms of Service (“Terms”). Please read them carefully. If you do not agree, please do not use the13.

1. Eligibility and Account Registration

1.1 Age and Jurisdiction

To use the13, you must be at least 13 years old (or the minimum age required in your jurisdiction, whichever is higher). the13 is a free game played for entertainment and bragging rights — there is no real-money wagering and no prize money. You are responsible for complying with the laws that apply to you, and you may not use the13 where doing so would be unlawful.

1.2 Account Creation and Responsibilities

Upon registering, you warrant that all information provided is truthful, complete, and current. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must immediately report any unauthorized use or suspected breach of your account security.

1.3 Group Entry Restrictions

the13 lets users form or join groups to compete in survivor-style contests. Entry may be subject to additional rules or restrictions (e.g., invitation-only participation, group size limits) set by group creators or administrators. Users must comply with all group-specific guidelines in addition to these Terms.

2. Gameplay: Premier League Survivor Rules

2.1 Game Mechanics Overview

Each player starts with 13 points at the beginning of the season or contest period. Points are lost each week based on match outcomes in accordance with the rules below. Gameplay is structured into weekly sessions synchronized with the Premier League calendar.

2.2 Weekly Picks and Scoring

• Making Picks: Picks must be submitted before the applicable cut-off time announced in-app.
• Team Usage Limits: A team may be picked only twice per player per season.
• Pick Locking: Picks lock once matches begin and cannot be changed.
• Missed Picks: Failure to submit a pick results in a standard penalty.
• Outcome and Points Deduction: A win deducts 0 points, a draw −1, and a loss −3.
• Tie-breakers: Goal differential may be used to resolve ties.
• Elimination: Elimination occurs at 0 points.
• Game Conclusion: The winner is the last user with points, or as defined by group rules.

User Responsibilities: You are responsible for verifying your pick submission. Failure to confirm may result in penalties or elimination.

3. User Conduct and Acceptable Use

3.1 Prohibited Activities

• Cheating, collusion, or manipulation of game outcomes
• Circumventing gameplay constraints
• Using automation or unauthorized tools
• Harassment or abuse of users or admins
• Posting illegal, obscene, or infringing content
• Unauthorized access to accounts or systems
• Disrupting user experience or platform integrity

Violations may result in suspension or termination of your account.

3.2 Fair Play and Fraud Prevention

the13 may implement anti-fraud measures such as IP tracking and gameplay analysis. Exploiting bugs or loopholes may result in penalties or bans.

4. Intellectual Property Rights and User Content

4.1 Ownership of Platform Content

the13 and its licensors retain all rights to the app, technology, design, and content. Use of the app does not grant ownership rights.

4.2 User-Generated Content (“UGC”)

• UGC remains your property but grants the13 a license to host and display it.
• You must ensure your content does not infringe third-party rights.
• the13 may moderate or remove UGC that violates these Terms or laws.

You agree to indemnify the13 for any claims arising from your content.

5. Account Suspension, Termination, and Effects

5.1 Suspension/Termination Triggers

Accounts may be suspended or terminated for violations of these Terms, legal requirements, or group rules, with or without notice.

5.2 Effects of Account Termination

• Loss of points, entries, and potential winnings
• Revocation of access to app and data
• No liability for data or asset loss

6. Disclaimers, Limitations of Liability, and Indemnification

6.1 Service Availability

the13 is provided “as is” and “as available.” Access may be affected by maintenance or external events.

6.2 Disclaimer of Warranties

the13 disclaims all warranties related to merchantability, fitness, accuracy, and reliability.

6.3 Limitation of Liability

the13 is not liable for indirect or consequential damages. Total liability is limited to USD $10 or fees paid in the past 12 months.

6.4 Indemnification

You agree to indemnify the13 for any claims arising from your conduct or content.

7. Dispute Resolution, Arbitration, and Class Action Waiver

7.1 Binding Arbitration

Disputes shall be resolved by confidential, binding arbitration with limited appeal rights.

7.2 Class Action Waiver

Users waive the right to participate in class or group actions. Disputes must be pursued individually.

8. Modifications to Terms

the13 may update these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use implies acceptance.

9. Privacy

Your use of the13 is governed by our Privacy Policy, which outlines data collection, usage, and protection.

10. Governing Law

This Agreement is governed by the laws of the jurisdiction where the13 is operated. Disputes not subject to arbitration shall be resolved in local courts.
